Deutsches Haus 75th Anniversary
To Tom Shinn, Colonel Richard Kuntz & Our Membership: Danke Schön! Standing room only and a unanimous positive vote at our Quarterly Membership meeting of September 19th will soon enable the Haus to gain all the benefits of a charitable and benevolent entity under the revised Internal Revenue Code of 1986. The Deutsches Haus was incorporated as a Louisiana non-profit corporation on November 7th 1928 and this first Charter alteration since that date is the fulfillment of a commitment made by Tom Shinn three years ago, when he ran for the presidency of Deutsches Haus. With the assistance of Colonel Richard Kuntz, who tirelessly researched applicable laws and wrote the proposed amendments, the Haus will soon claim exemption from the annual filing and paying of income taxes on the revenues it derives from the Oktoberfest and other activities. These savings will be redirected into Haus projects and capital improvements. Donations to the Haus will provide the donor with a deduction on his/her individual income tax return. The 99-year limit on the duration of the Corporation will be superceded by a perpetual Charter. Other provisions of the code have also been met. It is difficult to imagine a more appropriate way to mark the celebration of our 75th-year anniversary. Vom Historiker des Hauses Colonel Richard A. Kuntz, AUS (Ret) Amending Our Charter: Are We Finally A 501 ( c ) (3)? The short answer is, NOT Yet. Although by the unanimous consent resolution at its 11 June monthly meeting , the Board approved several critical amendments to convert our 75 year old charter into a modern day entity, conforming to all the provisions of the 1986 Internal Revenue Code, much work remains to be done. Following the above Board action, the proposed amendments were publicized for 3 consecutive days in the latter part of June, along with the legal notice calling for a house membership vote at its 19th Sept Quarterly meeting. With the Heidelberg Hall filled to capacity and with standing room only remaining, the membership enthusiastically adopted without a single dissenting vote, all of the proposed amendments. As you read this, the newly adopted amendments will have been registered with the Louisiana Secretary of State in Baton Rouge and recorded in the Orleans Parish Mortgage Office prior to submission of the detailed application (Form 1023) to and for review and approval by Federal authorities.
